It would have to be a very small kit not to meet the 3:1 rule. I guess if the ride cymbal is low over the floor tom and the overheads are low it might not meet the 3:1 rule. But then you might as well call the overhead over the ride cymbal, 'ride cymbal' instead of overhead.
One of my favorite mic setups for drums live is one mic just above the drummers left ear pointed at the snare and another for the bass drum. For a right handed drummer.
