Sorry to hear Eric! I sincerely hope you can resolve this with the guy.

I think in the end, people are decent and want to do the right thing. I hope you guys can find a way to access that part of the guy. I'm sure in the end he doesn't want a problem.

Thx for keeping us informed. Any alternative plans should this fail? What is the condition of the bodies as-is, right now? I know a lot of guys have good DIY skills and could possibly take care of any remaining issues, but that depends on what those issues are I suppose.

Edit: another thought; what about having another shop do the fix; depending on price I bet a lot of guys wouldn't mind paying a little more for it, even ones who have paid. Although of course I can't speak for anyone else, if it was an extra $25 or something per body, I for one would be willing to pony up for it. Never hurts to get a quote, and then ask the group. I think most of us are just anxious to get things moving again, and put the obstacles behind us. Just some more thoughts.

As a participant in this buy, I second the motion for having someone else take a look at the issue(s) for a few bucks more.  Litigation seldom brings the desired results.

I have been talking with Eric about this... needless to say...

He sent us a very good corrected prototype after the initial one, and to me that means he is capable of doing it. We are going to push forward, adapt and overcome.

The mics in their current state: Headbasket geometry issues is the big thing. I had pics earlier in this thread of the mics, you could see some of it there. It's more apparent in person.

I agree that litigation doesn't work most of the time. Really don't want to go there, and I don't think we have to -- yet. I have a few ideas to bounce off of Eric after sleeping on it. The frustrating part is that they are SO CLOSE...
 
It's probably not worth it to go through with litigation, but sometimes a letter from a lawyer serves as a good motivator….
 
As much as this sucks and I would like to see this Machineist pay through the nose gut and experience tell me the Lawyer / Court is going to cost us more and give us very little.
Guys I think it's time to find a new Machineist, this guy may be capable, but is he willing ? We can't force him to do it right in any quality and timely way.

So let me say it loudly this sucks!! I reached out to the local mediation center in his county. My goal here is to do one of two things. Have him produce what is promised, or refund the cost to fix them. Its that simple. The guy took on a job that he didn't have the skills to complete. It was pretty clear about half way through the process. But to be honest the guy was very nice up until the point I asked for half of the money back, that's when things got ugly.
I will be updating as I hear more. For now I am waiting for this mediation to happen. In terms of a machinist I have a very good and trusted guy that has agreed to a price. The only reason I didn't use this guy on the onset is because he was out of the country.

Sounds like he quoted it wrong and should have built in more headroom for his time.

If he's got the mic's and he's not going to complete the job we might want to get them back and go from there.

Determining/enforcing very specific "In/Out of spec" tolerances may be hard to do from a legal standpoint without a signed agreement detailing such tolerances, funding, and rejections/returns.

What kind of time/materials loss would he likely incur to "make-good" at this point?

Just my thoughts but I hope he comes around.

If I understood correctly, the guy did a good job on the prototype or we would not be in this position. Apparently he does have the capability, at least for one-offs.

Going out of country sounds extreme. Shipping costs? There are machinists everywhere. Just a thought.

Sounds like he's local.
The only reason he didn't use him, the machinists, in the first place, was because at the time he was out of the country, not the mics.
 
He DID do a good job on prototype #2! The first one we had to correct a couple of things and asked him to tighten up the head basket. #2 was great. That is what makes it frustrating. I don't want him to "give up"… Communication is SO KEY to any project or endeavor.

The other machinist was out of the country at the time, from what I recall talking to Eric…

The mediator got back to Eric and will be calling the machinist to schedule a conference call with all of us. Eric did get ahold of me today actually.

We have plans on how to progress from here. I cannot post much online but please PM myself or Eric if you have questions for us.
 
I just wanted to post today to let you guys know that:

1. We are ACTIVELY working behind the scenes on resolving this.

2. This process is taking a lot of time, and we really can't post all the inner details online here.

3. I want everyone to know that we value each and every one of you and are doing what it takes make sure these are the best they can be. It is the only right thing for us to do.

That being said, I have been pretty quiet about all of this in part because of a lot of family stuff happening at the same time. Health issues with my mom, and then 2 deaths in the family right before Christmas (One was my uncle Len, who was a huge music writer - he interviewed Sting, Mick Jagger, Billy Joel, ... crazy!).

The other part is we don't want to say anything here that's not constructive and would not help the process along. I FIRMLY believe that the right result can happen. There has been a good "pause" of time that has hopefully let the machinist (and us too) settle down, and it's the time now to go back to the table and get this worked out. Even with the issues that we have, I see a lot of good things in the mics, and I do believe there is very much a path to success! When we have a mediation booked / get to the next step, we will update the thread.
 
Great news guys ! I think until this is all resolved, it might be best to keep us informed via PM.
I don't want you guys to end up in a situation where a posting here could be misinterpreted, misused, or misconstrued because of something posted in a public forum.

It's not like we have any big secrets or anything, but yes, we won't post much here until we know what's going on. Again, any questions, please PM myself or Eric. I will say I am feeling good about this.
 
I'd be pretty interested in one of these if there's a successful run going again.
 
Good news: We had a very productive mediation meeting yesterday! We are ironing out a few details, will post more shortly.
